US Judge Mandates Freedom of Abrego Garcia from Immigration Detention

Legal proceedings

A court has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, finding his continued detainment is without lawful basis.

"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge wrote in her order.

The case originates in a mistaken deportation to El Salvador earlier this year, which US authorities later acknowledged was an mistake. After his return to the United States to face human smuggling allegations, he was held in federal custody.

In her order, the judge noted that the authorities lacks a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."

Background of the Legal Challenge

The court challenge center on conflicting claims. While the former administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he vehemently disputes this allegation.

He has also pleaded not guilty to the conspiracy counts, which are part of a separate trial in Tennessee.

Conditions of Freedom

The court, who was overseeing his challenge to removal in a federal court, ruled that he must now adhere to the conditions of his bond from custody in Tennessee. This decision shifts his monitoring to the jurisdiction handling his criminal case.

This ruling represents a notable turn in a complex legal case involving allegations of mistaken imprisonment and contested criminal associations.
